Pretoria - The North West High Court on Thursday dismissed Ngaka Modiri Molema District Municipality (NMMDM) application for the court to interdict the provincial government from appointing an Administrator.
NMMDM’s application, which was launched earlier this month, also requested the High Court to suspend the Executive Committee’s (EXCO) decision to dissolve the municipality’s council.
The Department of Local Government and Human Settlements on Friday said the provincial government opposed the application, saying for a substantial period of time, the municipality had persistently failed to fulfil its executive obligation under the Constitution and national legislation.
The department added that the application was heard by the court yesterday, and an order was made immediately by the court, dismissing the municipality's application with costs.
“The effect of the order is that the dissolution of the council is effective and the Administrator should immediately assume his obligations and responsibilities in the municipality and ensure that basic services and compliance with legislative obligations are met,” the department said.
At the beginning of September, the EXCO took a decision to dissolve the council of the municipality. - SAnews.gov.za
