Panel to review Pistorius's parole

Friday, September 18, 2015

Pretoria - The Correctional Supervision and Parole Board (CSPB) will today consider the legality of Oscar Pistorius’s placement under correctional supervision.

On 5 June 2015, the CSPB of Kgosi Mampuru II Correctional Centre, had taken a decision to place Pistorius under correctional supervision on 21 August 2015.

However in August, the Justice Minister Michael Masutha suspended and referred the decision to release the athlete back to the board for review, saying it had been granted prematurely.

The Minister stated then that in terms of the law, the parole board should only have considered the offender for release after he had served a sixth of his sentence.

Section 73(7)(a) of the Correctional Services Act, Act 111 of 1998, states that a person sentenced to incarceration under section 276(1)(i) of the Criminal Procedure Act, must serve at least one sixth of his or her sentence before being considered for placement under correctional supervisor, unless the court directs otherwise.

A ruling is due later today on whether that decision was correct.
