Home Affairs notes judgement on Muslim marriages

The Department of Home Affairs has noted a judgement by the Western Cape High Court ordering the state to introduce legislation to recognise Muslim marriages within 24 months.

On Friday, the Western Cape High Court ordered that the State is obliged to introduce legislation to recognise Muslim marriages as valid, and to regulate the consequences of these unions.

The application for the recognition of Muslim marriages was brought by the Women's Legal Centre, which said it was aimed at providing Muslim women and their children with legal protection upon divorce.

“We are in the process of studying the order and will make further comments in due course. We also note that the decision is subject to confirmation by the Constitutional Court,” the department said on Sunday. – SAnews.gov.za
