NDPP decision was rational: Presidency

Pretoria - The North Gauteng High Court will today hear an application brought by the Democratic Alliance (DA) to review the 2009 decision to discontinue the prosecution of President Jacob Zuma.

The DA wants a review of the decision -- by then acting National Director of Public Prosecutions (NDPP) Mokotedi Mpshe -- to drop charges against Zuma before he was elected President on the grounds that the decision was irrational in law and unconstitutional.

In a statement issued on the eve of the case, the Presidency said President Zuma has always contended that the court proceedings are an abuse of process by a political party in order to advance a political agenda.

“The court application has been relentlessly pursued over a period of some seven years and seeks to review and set aside the NDPP’s decision...

"Through his submissions to the High Court, President Zuma will maintain that the decision of the NDPP was rationally derived at, as evidenced by the reasons advanced and accordingly, will withstand any scrutiny,” the Presidency said. – SAnews.gov.za
