Legal Aid acknowledges Marikana ruling

Pretoria - Legal Aid South Africa says it acknowledges the South Gauteng High Court ruling that it should provide legal funding for the arrested and injured miners in the Farlam Commission of Inquiry.

“We are studying the judgement in consultation with the Management Board and will be in a position to comment further in due course,” said Legal Aid SA spokesperson, Mpho Phasha.

On Monday, the high court ruled that Legal Aid must fund the legal costs of the miners and their families represented at the Farlam Commission of Inquiry into last year's shooting at Marikana.

The workers had earlier failed to obtain an interim order in the high court in July to compel government to provide them with funding, pending the review of the decision by Legal Aid South Africa and Justice and Constitutional Development Minister Jeff Radebe not to provide them with funding.

The Farlam inquiry is investigating circumstances leading to the death of 44 people during strike-related unrest at Lonmin Platinum last year.

During the unrest, 34 mineworkers were shot dead by the police on August 16, while 10 people, including two policemen and two security guards, died in the preceding week. – SAnews.gov.za
