Pretoria – President Jacob Zuma has welcomed the release of the record relating to the so-called “spy tape”.
The Supreme Court of Appeal last week ruled that the National Prosecuting Authority (NPA) had to comply with a previous order to release the tapes within five days. This after the Democratic Alliance (DA) made an application to have the tapes released.
The Presidency said the Supreme Court of Appeal (SCA) had ordered the record to be produced and lodged with the Registrar of the High Court, Pretoria.
This record should include a copy of the transcripts, recordings and internal memoranda insofar as these do not breach the confidentiality between President Jacob Zuma and the National Prosecuting Authority.
The record, which the Presidency said is being filed, was after consultation and verification by the NPA, the DA and lawyers representing the President.
“Judge Hurt will on Thursday also be furnished with separate internal documentation which he will consider in light of whether it reveals President Zuma’s confidential representations to the NPA or not.
“All of this emanated from the agreement which the parties reached and which was presented to the SCA for incorporation into the order of court,” said the Presidency.
It added that this process was designed to determine what constitutes the record upon which the NPA decision was based.
