Westinghouse withdraws application to interdict Eskom

Pretoria - Westinghouse has withdrawn its high court application to interdict Eskom in a tender that would see the replacement of steam generators at the Koeberg nuclear power plant, the parastatal said on Thursday.

“Eskom confirms that it has received notice through Westinghouse’s attorneys of the withdrawal of its application to the High Court of South Africa, Gauteng Local Division, Johannesburg, to interdict Eskom from concluding its contract with the winning bidder,” said Eskom.

The matter related to Westinghouse’s filing of an urgent application to the court in order to see documentation relating to Eskom’s awarding of a R4 billion tender at Koeberg.

It had been reported that Westinghouse had said that it had been declared the winner of the tender. In August, Eskom announced that it had awarded the tender to another company.

Matshela Koko, Eskom’s Acting Group Executive for Technology and Commercial, said: “I am pleased that Westinghouse has seen the light on this matter. With this matter behind us, Eskom is proceeding with the implementation of the Koeberg Steam Generator Replacement project as planned”.

The entity said it is satisfied with the integrity of the process and has ensured that the process remained fair and in adherence to good governance.

Eskom’s internal approval processes for the replacement of the Koeberg Steam Generators (SGRs) have been completed, and the contract has been awarded to AREVA NP Proprietary.

“The relief sought to access the documentation leading up to and forming the basis of the Eskom decision in the procurement of the Steam Generators will be heard tomorrow. Eskom has been working to provide such documentation in any event on the basis of a formal request via Westinghouse’s attorneys of record,” explains the parastatal. – SAnews.gov.za
