Authority welcomes high court decision on SIA application

Pretoria – The council and executive management of a Private Security Regulatory Authority (PSIRA) says it has noted and welcomed the decision of the North Gauteng High Court to dismiss the application by the Security Industry Alliance (SIA) to set aside annual fees regulations of the private security industry.

In a statement on Tuesday, the authority said in 2012, the SIA took PSIRA to court in order to have its annual fees regulations reviewed and set aside.

The SIA had successfully interdicted PSIRA from implementing reviewed annual fees regulations. The interdict meant that PSIRA could not collect or force security companies to pay the new fees.

On Monday, the application of SIA was dismissed with costs. Among the reasons given for the dismissal were that courts cannot interfere with executive policy decisions and that  PSIRA complied fully with the Promotion of Administration Justice Act.

Manabela Chauke, Director of the Private Security Regulatory Authority, said: “PSIRA views this decision as a victory for security officers, public and the industry at large. This outcome will result in security businesses now contributing towards the regulation of the industry equally with security officers.

“The contributions will enhance better and capacitated regulation of the private security industry.”- SAnews.gov.za
